CONDITIONS OF ENTRY

Background

• The "Promoter" is Marine Deals Ltd, located at 410 Rosebank Road, Avondale, Auckland.
• Information on how to enter this "Promotion", mechanics of entry and prizes forms part of these "Conditions of Entry". Entry into this Promotion is deemed acceptance of these Conditions of Entry. 

Eligibility

• This Promotion starts on the 1st of July 2023 and ends at 11.59pm 31st of July 2023("Promotion Period").
• The Promotion is only open to "Eligible Entrants" who are residents of New Zealand aged 18 years or older, and who are not directors, management and employees of the Promoter and its related entities (and their immediate families), printers, suppliers, providers and agencies associated with this Promotion. 

Entry Conditions

• To enter this Promotion, an eligible entrant must spend over $199 in a single purchase from Marine Deals, either online at marine-deals.co.nz or in store during the promotional period.
• By doing so, Eligible Entrants agree to these Conditions of Entry for the Promotion.
• There will be 1 "Winner" of this Promotion. This Promotion is a game of chance; skill plays no part.
• The Entries will be collated on the 1st of August 2023 by Marine Deals. The eligible winner will be randomly selected.
• The Winner shall be notified by phone or by a visit from Scott and Mig, Presenters of Fishing and Adventure, which may be filmed.
• Incomplete, inaccurate, erroneous, ineligible or incomprehensible Entries will be deemed invalid. Entries must be received by the Promoter during the Promotion Period. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for late, lost or misdirected entries. 
• Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission.
• The successful entrant must agree to be filmed. Aspects of the promotion and prize trip will be filmed by a production company and used across Surtees marketing.

Prize

• The Prize is one day's fishing for 4 people with the team from Fishing & Adventure in either Raglan, Kawhia, Auckland, Tauranga and Firth of Thames on Holy Ship including catering.
• The successful entrant must find their own way to the boat ramp on the day of the trip.
• Winners must be available on the 12th of October 2023. Dates are non-negotiable.
• If the weather forecast does not allow the trip to go ahead, the entrant will be notified 4 days prior to the trip date. One weather date will be offered.
• The total Prize value is up to NZD$8,700 plus GST. The Prize is not transferable or exchangeable. The Prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in the Prize values.

General Information

• The Eligible Entrant acknowledges that they are providing their personal information to the Promoter for the purposes of this Promotion.
• If the Prize or an element of the Prize becomes unavailable, for any reason beyond the Promoter's reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu. 
• Unless expressly stated in these terms and conditions all other expenses including travel to and from the event/departure point etc become the responsibility of the winner.
• It is a condition of accepting the Prize from this Promotion that the Winner may be required to sign a legal release/s or release/s in a form determined by the Promoter in its absolute discretion. 
• The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
• The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures. 
• The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking the Prize or using the Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). The Promoter and its agents associated with this Promotion take no responsibility for the Prize (or part of the Prize) damaged or lost in transit (if relevant). 
• If for any reason this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or if necessary to provide an alternative prize to the same value as the original prizes, subject to any written directions made under applicable State or Territory legislation. 
• The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 
• As a condition of entering this Promotion, an Eligible Entrant consents to, in the event they are a Winner, the Promoter using the Winner's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Eligible Entrant agrees that, in the event they are a Winner, the Eligible Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents. 
• An Entry and any copyright subsisting in an entry irrevocably becomes, at time of Entry, the property of the Promoter. The Promoter collects personal information about an Eligible Entrant to include the entrant in this Promotion and, where appropriate, award the Prize. If the personal information requested is not provided, an entrant cannot participate in this Promotion and is deemed ineligible. An Eligible Entrant also agrees that, in the event they are a Winner, the Promoter may publish or cause to be published the Eligible Entrant's name and locality in any media, as required under the relevant State or Territory legislation.

Facebook Conditions

• This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook.
• By entering this Promotion, each entrant releases Facebook from any action or claim arising out of the Promotion.
• At all times, entrants agree to act in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at https://www.facebook.com/legal/terms.
• Posted Comments must not include any swearing, derogatory or racist commentary, inflammatory commentary, imagery or commentary displaying alcohol abuse, imagery including nudity and/or unauthorised commercial communications such as spam and any such posts or comments will be removed by the Promoter.
